Limited warranty

C&A Lone Star Flooring (“Lone Star”) warrants, for a period of twelve (12) months from the date of completion of installation (herein the “Warranty Term”), that the flooring and/or other products (herein the “Products”) purchased by the Property Owner from Lone Star and installed by Lone Star, will be installed (i) in a good and workmanlike manner and (ii) in compliance with the published installation specifications of the manufacturer and/or vendor (herein jointly the “Manufacturer”) of the Products. Although not provided directly by Lone Star, in addition to this limited labor warranty from Lone Star, the Property Owner shall be entitled to the benefit of any Manufacturer warranty(s) provided by the Manufacturer related to the Products. As to Lone Star, all other warranties, express or implied, are denied, including, without limitation, the implied warranties of merchantability and/or fitness for purpose. Notice of a claim made under this limited labor warranty must be provided, in writing, by or on behalf of the Property Owner within the Warranty Term. In the event that a claim is made that falls within the provisions of this limited labor warranty, Lone Star, at its sole option, will either repair any installation not in compliance with this Warranty and/or replace the damaged portion of Product to the extent such Product was damaged as a result of installation not in compliance with this Warranty. The foregoing shall be the sole obligation of Lone Star as to any claim made incident to this Warranty. Lone Star specifically disclaims any and all liability, if any, for any consequential damages, if any, as may be attributed to a claimed violation of this Warranty. Lone Star further disclaims any and all claims for damages to the Products caused by (i) abuse, (ii) modifications to the Products and/or the installation of same, not completed by Lone Star, (iii) improper or insufficient maintenance and/or (iv) normal wear and tear.
